Terms of Service

By creating a Ditch The Spike account you agree to these Terms of Service. If you do not agree, do not use the app.

Ditch The Spike is a behavioral metabolic awareness app. It helps you log meals and glucose readings, identify personal patterns, and make informed food decisions based on your own data.

DTS IS NOT:

• A medical device
• A diagnostic tool
• A substitute for medical advice, diagnosis, or treatment
• A certified continuous glucose monitor (CGM)
• An emergency or crisis response service

Always consult a qualified healthcare professional before making changes to your diet, medication, or treatment plan.

You must be at least 13 years old to use DTS. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian's consent.

You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us immediately at zain.rafique@gmail.com if you suspect unauthorized access.

DTS offers a Free plan, a Premium monthly subscription, and an Annual subscription. Paid plans include a 14-day free trial. You may cancel at any time from the Billing page.

• Subscription fees are billed in advance and are non-refundable except where required by law.
• Cancellation takes effect at the end of the current billing period; you keep access until then.
• All payments are processed by Stripe. We do not store your card details.
• We may change prices with at least 30 days' notice by email.

You agree not to:

• Use DTS for any unlawful purpose
• Attempt to access another user's account or data
• Reverse engineer, scrape, or interfere with the service
• Upload content that is illegal, harmful, or violates another person's rights
• Resell or commercially redistribute the service without our written consent

You own the health and behavioral data you enter into DTS. You grant us a limited license to store, process, and display that data solely so we can provide the service to you (and to any caregiver you invite).

The Annual plan allows you to invite caregivers to view your data in read-only mode. You control invitations and can revoke caregiver access at any time. You are responsible for who you choose to invite.

DTS provides informational and behavioral insights only. It does not diagnose, treat, cure, or prevent any disease. Never disregard professional medical advice or delay seeking it because of something you read or see in DTS. In a medical emergency, call your local emergency number immediately.

We work hard to keep DTS available, but we do not guarantee uninterrupted access. The service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.

To the maximum extent permitted by law, Ditch The Spike, its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim.

You may delete your account at any time from your Profile page. We may suspend or terminate your account if you violate these Terms or if your account poses a risk to us or other users. Sections that by their nature should survive termination will survive.

We may update these Terms from time to time. Material changes will be announced by email and via an in-app banner at least 14 days before they take effect. Continued use of DTS after changes take effect constitutes acceptance.

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of British Columbia, subject to any non-waivable consumer rights in your jurisdiction.
